1. ROGER1 KELLY was born Abt. 1629. He married MARY.
A Judge accused my 8th Great-Grandfather of having "A Loose Life". I wonder if the judge knew that the name Kelly comes from the ancient Gaelic "geallac", meaning troublesome or contentious.
ROGER was a fisherman at the Isle of Shoals. First appears as mate of the ketch -HOPE- on a voyage to the West Indies in 1662. On the death of the master at Nevis, he finished the voyage and made another voyage to Nevis after turtles, in 1663 for owners, Francis Robinson and Edmund Brown. As a result of a civil suit growing out of this voyage, he spent 15 weeks in Boston prison in 1664, and sued unsuccessfully for damages. On the turbulent Shoals he and his wife MARY led a turbulent life, constantly in the courts. He in civil actions with his crew and customers and she as the result of an abusive tongue. First accused of selling without a licence in 1666, he afterward kept a public house licence as late as 1693. The following is a few accounts of Roger and Mary Kelly's troubles. Most were obtained from the 'Maine Province & Court Records' (Me. P&CR). I left it in the original spelling so as not to dilute the quaintness of their words or their accents.
In 1669 Mary Kelley, wife of Roger was presented in court for "abusing of her neighbours in an unseemly manner with badd words."
15 Sept 1668: Roger Kelly being Complained of unto this Court for severall abbuses Carrages Towards Mr. Babb & his wife & ill Cownsell given to persons from time to time that Induces him to this Court suspicions to be of A Loose Life, This Court sentance him to be admonished for time to Cum that he cary it better & to be bowned in a Bond of 10 li to be of good behaviour Towards all persons, especially Towards Phillip Babb and his wife.
Roger Kelly acknowledged himself to stand bound in the sum of 10 li according to order of Court above.
Roger Kellys bond is Canscld Att a Cownty Cort held in Yorke the 6 of Jully 1669 per the sd Kellyes appearance:
Non appear agains him & hee is acquited of his bond.

In 1668, as a constable, ROGER KELLY was assaulted by Bartholomew Michell & Rebecca Downes. [yes, Roger was a Constable in 1667-68]
In 1674 Roger Kelly brought suit against Lewis Tucker for reporting that Mark Row, Edward Holland and John Badston were drinking and lay drunk at his house in his cabins.

Mr.Roger Kelly had had William Hilton jailed for assaulting James Neale. The depositions were taken 20 Dec.1677 before Peter Twisden, Commissioner,N. H. Court Files 15971.

Roger Kelly's Boat, moored in Smuttynose Cove, shortly was cast adrift. Soon after this John Andrews, Samson White and William Hilton, 'comming home along to the said Kelly's dore of his house, and threatening his men to come out' and fight-which they did not - 'but the said Hilton, Andrews and White' being charged with casting her off, Samson White took hold of John Ashe by his neckcloth as he stood at said Kelly's door.

Friday night Dec. 14, being in the house of Mr. Reuben Hull and hearing an outcry went out to the end of the house and did see Henry Harvey, James Nealle and John Ashe have holt of William Hilton by the collar, and several of Mr. Roger Kelly's men surrounding said Hilton.
Nathan Quicke (age 35) saw William Hilton violently strike Roger Kelly's servant James Neele with an oar.
Henry Harvey (age 28) saw William Hilton run at James Neele and strike him down with an oar or a boat's foremast, and strike him several blows after he was down.
Elisha Barton (age 22) saw William Hilton passing by Mr. Kelly's door, Henry Harvey called him lubber and logerhead. Said Hilton told said Harvey If he had anything to say to him he should come to him. Then said Harvey with James Neele and John Ash went out and he did run into Mr. Hull's yard 'and took up a small canno ower to defend himself, but whether he did strike one of them I know not.'
John Ashe [age 22] saw John Andrews and William Hilton cast off the moorings of Mr. Kelly's boat. Clement Hardy encouraging them. When I got home John Andrews, Sampson White and William Hilton were challenging Mr.Kelly's family to come out and fight saying we should not make fast on Mallago side.
Note: Robert and John Andrews and William Hilton mentioned above are my 8th Great-Grand uncles. ROGER KELLY's Great-Granddaughter, LYDIA WELCH, married JOHN ANDREW'S Great-Great-grandson, MANWARREN BEAL.
In 1702, the Inhabitants of the Isles of Shoals petioned York [Maine] court regarding a Saint's Bell now in the secret custody of Mr. Roger Kelly, asking the court to deliver the bell to Mr. Thomas Diamond & Mr Richard Goss, the selectmen.

KELLEY Vs. SNELL
Roger Kelley is plt by a demurr upon plea of Title to a Certain Island known by the name of Mallagoe Island in Controversie between sd Kelley and Mr George Snell of Portsmouth [N.H.]: it being originally an action of Trespass brought by the sd Snell the plt against the sd Kelley Defendant before Joseph Hammond Esquire one of her Majestys Justices of the peace The defendant demurring as aforesd bringeth this Suit for Tryall of the Title of the sd Island on which the Trespass was Aledged to be done against the sd George Snell now defendant.
The Jury finds the title of the sd Island for the defendant one shilling dammage and costs of Court, The Court Confirming the verdict. The plt Appeals from this Judgment unto the Next Superiour Court of Assize and Generall Goale delivery to be holden at Boston for the County of Suffolk on the first Tuesday in November next and the sd Roger Kelley Principle and Elisha Kelley and Jarvis Ring his Suretys acknowledge themselves to be holden and Stand firmly bound and obliged Joyntly and Severally that the sd Roger Kelley shall proscicute his sd Appeale with Effect and abide the order of the sd Superiour Court there on & c. [George Snell, the defendant, had married Hannah (Fernside) Hull, widow of Reuben Hull of Portsmouth, N.H. former owner of the island. Dodevah Hull, to whom Kelly applied for permission to build on the island, was the son of Rueben and Hannah. There is no evidence among the existing papers to suggest that Dodevah possessed any right to enter into agreement regarding the island; his mother and step-father were executors of Reuben Hull's estate. Neither can we tell from the remaining evidence whether Kelly had Dodevah's approval or whether he simply went ahead with his plans.]

3. [Agreement between George Snell and William Tucker for use to the Island in 1702. Whether this was renewed cannot be determined on the basis of remaining evidence, but it certainly indicates that in 1702, George Snell possessed the right to control use of the property:]
Know all men by these presents that I William Tucker now Resident on Smutenose on of the Iles of Shoals fisherman hath hired mallagoe Iland to make his fish this sumers voyg and is to Give one kentol of Good vittel fish for my house...to Mr:Geo:Snell at his house at Strabery banke [Portsmouth, N.H.] at the End of this instant Sumers voyg and then to surender up a Gaine the sayd Iland into the posesion of sead Snell until a new rent act be made & witness my hand this 5 day of June 1702.

It is not known if the Phillip Odiorne mentioned above is the same Phillip Odiborne mentioned below.
27 May 1684: Presentment made by the Grand Jury and given in to the Honored Court of Pleas at Wells [Maine] the 27th day of May:1684:
Wee present Roger Kelly, for abuseing the wife sd Phillip Odiborne, by uncivil Actions, as footeing upon her, and dragging of her about in an unseemely manner.
On 15 July 1684 at the Ysles of Shoals he was Convicted for this presentment and sentenced to pay 20s and officers fees 5s and witnesses 3s, which was done accordingly.

Richard Oliver is Plantiff In an Action of Defamation in reference of Mary Kelly, Contra Roger Kelly Defendant in behalfe of sd Kelly's wife for defameing of the Platiif.
The Court finds for the Plantiff, Costs of Court 01 pounds 10s 00p. And do further order that Mary Kelly shall make a publique acknowledgment for her defameing of Richard Oliver by Chargeing him with such an high crime as of murthering a person, which shee was, not able to prove at some publique meeting at the Ylse of Shoals, or if no such meeting in a Short tyme then to do so at the next Court to be houlden at Smuttynose Ysland by order of the Authority of this Province on November [first written Oct] next, or on her default thereof the sd Roger Kelly her husband to pay five pounds to the Plantiff, Ric:Oliver. John Frost Junior of the North Isles of Shoals Alias Smuttinose Island being bound to this Court by recognizance with condition for the good behavior and to answer for his most horribly Abuseing his Grandfather Mr Roger Kelley of sd Isles of Shoals and for Prophane Curseing & Swareing and takeing the holy name of god in vaine with Sundry other high Misdemeanours Contrary to the peace of our Soveraign Lady the Queen he Submiting himselfe to the Court Begging their Clemency Acknowledging his sd offences and promissing Reformation for the future he is Adjudged for the Abuse done his Grandfather to recieve Publick Admonition and for his Cursing Swareing & carrages to pay a fine of ten shillings to the poor of sd Smutinose Island and to pay fees of Court and to Stand Comitted till done
And the sd John Frost principle and Thomas Manering his Surety acknowledge themselves bound and firmly obliged Joyntly and Severally unto our Soveraign Lady Queen Anne in the Summ of Ten pound that the sd John Frost Junior Shall Appear at the next Sessions of the peace and in the mean time be of good behavior towards her Majesty and all her Lieqe People.
The Cost of proscicuting & Court fees 1 pound 15 shilling 6 pence
{Even at the advanced age of 76 Roger Kelly lived in a turbulent environment, in which the ties of blood relationship were no guarantee of smooth sailing. In this instance, the case was first heard by Joseph Hammond, J.P., Kittery, one week after the episode.}

The deposetion of Roger Kellee ageed about 76 years testefieth & saith that on Satterday Last Past him selff & son Elisha Kellee were on Smutenose Iland & going downe to their Cannow to goe a bout their busnis; & Tho:Mannering & John Frost Cam down affter them to sd Cannow: & sd frost had his collar open:as Iff he intended to fight my Son being at the head of the Cannow sd frost violently Laied hands on my sd Son & pushed him back A considerabell way: & sd Manry [threatening? not clear] sd son to fight....[Taken before Joseph Hammond, J. 3. The Depositions of Samuel Mathews, John Shory & John Shay all of full age... that on Saturday the 16 Instant Mr. Roger Kelly, Elisha Kelley and we the Deponants were coming from the Isle of Sholes in order to Come over to the Maine, and as we were coming into a Conoe to goe on board our boat John Frost Junior came down to us and began most horibly to abuse his Grandfather the sd Mr Roger Kelly, telling of him he was a fals man and his books were false & called his sd Grandfather old Rogue and old Athiest and Said he would prove him so and further the sd Frost sd to said Kelley & we that were with him, Damn your Souls you are all going to the Devill and I pray God you may never come back againe and the sd Frost Swore by God Severall times and Challenged Mr Elisha Kelly to come ashore and he would fight him.

4. The Deposition of Mary Brittaine aged 34 years or thereabouts testifieth that on Saturday the 16th of June instant John Frost goeing to the waterside at the North Isle of Shoales Called Smotty Nose in Order to ask Elisha Kelly to (come his Acount?) with him he the Said Elisha Kelly did Violently Assault and lay hold of Said Frost and Rent and Tore A Great part of his Shirt downe the Breast & Called him [word uncertain] Basterd; And further sayth that the Blew Sprickled Shirt now Shewen in Court Is the Same Shirt which was Tore and Rent as abovesd.

John Deleha Testifieth that on or about the eighth day of July last past he went into Mr.Roger Kellys house to speak with Mr.Elisha Kelley I found nobody within So that I sat down by the fire Expecting sd Kelly would come in but while I was Sitting old Mr.Roger Kelley {He was 77 years old!}came out of the other Room and Stroke me on the head with his Cane Several blows and break my head, in the mean time I did Indeavor to defend my Selfe but in what manner I am not Sencible at present

Despite all this ROGER KELLY was a Constable in 1667, Selectman 1679, local Justice of the peace in 1680 and 1699, County Justice 1692, 93, 95, 96 and Deputy to the General Court in 1692. Aready a landowner in 1662, be bought land on Smuttynose from Nathaniel Fryer in 1668, and a house and 10 acres at Crooked Lane, Kittery, Maine, in 1698. He was part owner of the -Endeaver- in 1692-3, with William Partridge of Portsmouth, N.H., Henry and Samuel Dow of Hampton, N.H. and others. In 1707, in Boston, he deeded to his son Elisha all his property, having made sufficient advances, to his other children, but his son Charles, claiming that his father had been blind some years and of impaired understanding, was able to upset the transfer of the Kittery land.

4 iii. Sarah Kelly. She married John Frost Abt. 1673. It was their son, John Frost, Jr., who "Abused" his grandfather in 1705.
5 iv. Abraham Kelly. In 1690, Abraham was presented in court for assaulting the constable of the North Isles of Shoals. Alexander Maxwell advanced Abraham's fine. Abraham's father, Roger, was appointed administrator of his estate on 4 April 1709.

2. Roger2 Kelly (ROGER1). He married Mary Holdridge 26 Sep 1681 in Exeter, N.H.. Roger Kelly is first mentioned in a suit by Jane, widow of Edward Eurine of Exeter, N.H., formerly of Shoals, for his wages on a 3-1/2 month voyage to Nevis and Jamaica in 1677.
Roger was living in Exeter, N.H. and was taxed there in 1682-3. He deeded 10 acres at 'three pitch pines' to Benjamin Taylor in 1696, and in 1701 quit-claimed 100 acres between his house and 'Jeremy's pocket' in the Stratham, N.H. patent lands with a warranty against 'any person that shall claim any legal right or title to my labor.'

3. WILLIAM2 KELLY (ROGER1) was born Abt. 1672. He married LYDIA BLAGDON, daughter of JAMES BLAGDON.
WILLIAM was a mariner. In 1747 William and Lydia quit claimed to their daughter and son-in-law, Mary and Charles Treadwell, all rights in the estates of JAMES and MARTHA BLAGDON, deceased, and ROGER and MARY KELLY, deceased. WILLIAM and LYDIA bought a house at Great island in 1698, mortgaged it in 1710 and redeemed it in 1727.
WILLIAM witnessed the will of Joshua Frye In 1703.
WILLIAM was sued by William Pepperell Esquire in 1706 for "withholding the Summ of twelve pounds & fourteen Shillings". William didn't show up in court so the "Court have Awarded Judgement against him by default and the Law directs and Costs of Court of 40 Shillings."
Note: Pepperell is kind of a cousin-in-law on mine. He helped his first cousin, William Deering, my first cousin 9 times removed, to escape from the prison in York, Maine. William Deering had murdered his wife with an axe, but that's in the Deering Family.
WILLIAM KELLY administrated the estate of his father-in-law in 1722. LYDIA KELLY relinquished administrator of the estate of her brother George to Sampson Sheafe on 16 May 1721.

6. Charles2 Kelly (ROGER1). He married Joanna Fernald 25 May 1698.
Charles Kelly lived in the Crooked Lane area of Kittery, Me., on the 10 acres owned by his father, which he defended successfully against an ante-mortem gift to his brother Elisha and finally gave to his daughter Mary in 1722. He was issued a licence to sell strong drink out of doors in 1698-9 and 1709. A mariner in 1718-23.
Child of Charles Kelly and Joanna Fernald is:
17 i. Mary3 Kelly, born 27 Dec 1699. She married James Scott Bef. 1725. In 1725, when she was Mary Scott, she sold her fathers Kittery property to Elihu Gunnison. Marys husband, James, was from Boston, Mass.
7. Elisha2 Kelly (ROGER1) was born Abt. 1675. He married Susanna Sloper Bef. 1702.
Elisha was a fisherman at the Isle of Shoals. He married before 1702, Susanna Sloper, daughter of Lt. Richard, when her sister gave Elisha Power of Attorney, calling him brother and gentleman. In 1707 Susanna lived at the house of her father-in-law, Roger Kelly. She was administrator to full command in Gosport Church on 29 Aug. 1736 with her daughter Hannah.
Elisha was licence to retail in 1699 and to keep a public house in 1700. He tried in vain to mortgage the house at Crooked Lane, occupied by his brother Charles in 1715, but succeeded with his own house on Smuttynose in 1717. a writ was returned 'non inventus' in 1719, but he was living in 1723 when he sold 6 acres on Star Island, land he inherited from his father.
On 3 July 1705 Elizabeth Mannering was accused of 'abuse threaten and evill Intreat Elisha Kelley of Smuttynuse Island of the Isles of Shoals. She not Appearing by reason of her indistposition of body her bonds are continued till the next Sessions.' [Me.P&CR Vol.4 pg.313]
Elisha and Susanna's children were baptized at Newcastle, N.H. 10 May 1719 as 'from Isle of Shoals' were doubtless his.

24 iii. Joseph Kelly, born 31 Jul 1722.
25 iv. Holdridge Kelly. Deacon Samuel Lane's list of those who died 1745/46 at Cape Breton, Nova Scotia included a Holdridge Kelly.

27 vi. Mary Kelly, born 17 Apr 1733. She married Joseph Huckins.

16. LYDIA3 KELLY (WILLIAM2, ROGER1) was born 1707 in Portsmouth, N.H., and died 19 Aug 1792 in Cape Elizabeth, Me.. She married GEORGE WELCH 1726 in Portsmouth, N.H.. George was born in England in 1701 and died in Halifax, Nova Scotia from poisoning in 1755. George was an early settler of Cape Elizabeth, Maine. He was of Pemaquid, taxed in Newcastle, N.H. in 1720.
